OSS-EC Terms of Use

RLL（下記、用語の定義）は、本使用規約の全ての内容に同意していただくことを条件に、本サイト（下記、用語の定義）にて紹介するコンポーネント製品をご使用頂くユーザ（下記、用語の定義）に、OSS-EC（下記、用語の定義）をダウンロードして使用または参考にすることを許諾致します。ユーザは、OSS-ECをダウンロードした時点で本使用規約に同意したものとされます。また、何らかの方法でOSS-ECを入手した時点で、本使用規約を承諾したものと見なします。本規約の各条項に同意されないときは、OSS-ECのダウンロード並びに使用しないでください。

“RLL” (Definition of Terms below) authorizes “User” (Definition of Terms below) of the component products described on “This site” (Definition of Terms below) to download, use, and reference the “OSS-EC” (Definition of Terms below), provided that they agree to all of the terms and conditions of this User Agreement. By downloading the OSS-EC, the user agrees to these Terms of Use. In addition, by obtaining the OSS-EC in any way, you are deemed to have accepted these Terms of Use. If you do not agree to the terms of this agreement, please do not download or use the OSS-EC.

用語の定義

• ”RLL”とは、Rui Long Lab 株式会社です。
• ”本サイト”とは、OSS-ECサイト(https://oss-ec.com/)です。
• ” ユーザ ” とは、OSS-ECを使用または参考にする個人または法人、団体です。
• ” OSS-EC ” とは、Open Source Software for Embedded ComponentsのProgram ファイルおよび関連ドキュメントファイルです。

1. Definition of Terms
– “RLL” is Rui Long Lab, Inc.
– “This Site” is the OSS-EC site (https://oss-ec.com/).
– “User” is an individual, corporation or organization that uses or refers to the OSS-EC.
– “OSS-EC” is the Program file and related documentation files of Open Source Software for Embedded Components.

OSS-ECの目的

OSS-ECは、ユーザがコンポーネントを利用した製品のプログラム開発の参考コードとして提供し、ユーザのプログラム開発に役立てることを目的としています。

2. Purpose of OSS-EC
The OSS-EC is intended to serve as reference code for the user to develop programs for products that use its components.

OSS-ECの使用承諾

RLLは、ユーザが「4. OSS-ECの使用条件」を全て満たす限り、以下のOSS-ECの使用または参考にすることを許可します。OSS-ECの使用とは、OSS-ECの複製、変更、結合を行い、コンピュータシステムへ組込むことです。本使用規約は、OSS-ECの修正版、アップデート版にも適用されるものとします。

3. OSS-EC Consent to Use
RLL permit the user to use or refer to the following OSS-EC as long as the user satisfies all of “4. OSS-EC Terms of Use” Use of the OSS-EC means to copy, modify or combine the OSS-EC and to incorporate it into a computer system. These Terms of Use shall also apply to modified or updated versions of the OSS-EC.

OSS-ECの使用条件

• ユーザは、「2. OSS-ECの目的」に沿い、OSS-ECが対象とするコンポーネント製品を利用すること。
• ユーザは、OSS-ECが対象とするコンポーネント製品の商取引条件並びに適用条件、取扱注意事項等を遵守すること。
• ユーザは、OSS-ECが対象とするコンポーネント製品の用途および使用する地域、国に対応する法規制、および用途への適合性、安全性等を確認、試験すること。
• ユーザは、OSS-ECが対象とするコンポーネント製品に適用される外国為替および外国貿易法、その他輸出関連法令を遵守すること。
• ユーザは、OSS-ECを大量破壊兵器の開発や軍事利用の目的で使用および提供することはしないこと。
• ユーザは、OSS-ECの再配布を禁止すること。
• ユーザは、「6. OSS-ECの免責」を承諾すること。

OSS-ECの権利

• OSS-ECに関する著作権(著作権法第27条及び第28条の権利を含む)及びその他一切の知的財産権はRLLに帰属します。本使用規約のいかなる内容も、OSS-ECにかかる権利の全部または一部をユーザに譲渡するものではありません。
• OSS-ECは、著作権法及び国際著作権条約並びにその他の知的財産権に関する法律及び条約により保護されています。

5. Rights of OSS-EC
– Copyrights (including the rights under Articles 27 and 28 of the Copyright Act) and all other intellectual property rights related to the OSS-EC belong to RLL. Nothing contained in these Terms of Use shall be construed as transferring to you all or any part of your rights in the OSS-EC.
– OSS-EC is protected by copyright laws and international copyright treaties and other intellectual property laws and treaties.

OSS-ECの免責

• RLLは、OSS-ECを「現状有姿」のままで提供し、明示的にも黙示的にも、商品性、特定目的への適合性、および権利侵害の保証を含むがこれに限定されない、いかなる種類の保証もありません。いかなる場合においても、RLLは、いかなる請求、損害、または損失に対しても責任を負いません。RLLは、その他の取引に起因する、契約行為、不法行為、その他の行為にかかわらず、いかなる請求、損害、その他の責任も負いません。
• RLLは、OSS-ECの恒久的なバージョンアップ及び不具合の修正義務を負いません。
• RLLは、ユーザに対し、OSS-ECに関するいかなる技術的役務の提供義務も負いません。
• RLLは、OSS-ECの仕様等について、ユーザへの連絡なく変更できるものとします。RLLは、当該変更によりユーザが被るいかなる損害に関しても、一切の責任を負いません。

6. Disclaimer for OSS-EC
– RLL provides the OSS-EC on an “AS IS” basis and without warranties of any kind, either express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall RLL be liable for any claim, damage or loss, and RLL shall not be liable for any claim, damage or other liability, whether in an action of contract, tort or otherwise, arising out of any other transaction.
– RLL is under no obligation to permanently upgrade the OSS-EC or to correct any defects.
– RLL is not obligated to provide any technical services related to OSS-EC to the User.
– RLL reserves the right to change the specifications of the OSS-EC without notice to the User, and RLL shall not be liable for any damages incurred by the User as a result of such changes.

本使用規約の変更

RLLは、本使用規約をいつでも、いかなる理由でも変更する権利を有します。そのような変更は、本使用規約に掲載されます。重要な変更を行う場合は、変更が有効になる前に、電子メール（ユーザのアカウントで指定された電子メールアドレスに送信）または本サイト上の通知手段によりユーザに通知します。RLLのOSS-ECの使用承諾に関する最新情報については、このページを定期的にご覧いただくことを強くお勧めします。

7. Changes to these Terms of Use
RLL reserves the right to change these Terms of Use at any time and for any reason. Any such changes will be published in these Terms of Use. If we make material changes, we will notify you by email (sent to the email address specified in your account) or by other means of notification on this Site before the changes become effective. We strongly recommend that you visit this page regularly for the latest information on RLL’s OSS-EC Consent to Use.

準拠法

本契約は日本国法に準拠するものとします。本使用規約に関する一切の紛争については、RLLの本店所在地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。

8. Governing law
This Agreement shall be governed by the laws of Japan. The district court having jurisdiction over the location of RLL’s head office shall be the exclusive court of first instance for any and all disputes related to these Terms of Use.

その他

• ユーザが本使用規約の内容に違反した場合、OSS-ECの使用許諾は自動的に終了いたします。この場合、ユーザはOSS-ECを破棄するものとします。
• 本使用規約に規定のない事項及び本使用規約の解釈につき疑義が生じたときは、RLLとユーザとの間で協議の上、解決するものとします。

9. Other
– If the user violates any of these Terms of Use, the license to use OSS-EC will automatically terminate. In this case, the user shall discard the OSS-EC.
– Any matter not stipulated in these Terms of Use or any question arising from the interpretation of these Terms of Use shall be settled upon consultation between RLL and the USER.
