OSS-ECAL Terms of Use

“We”(as defined below) provide “OSS-ECAL”(as defined below) to “OSS-ECAL Users”(as defined below). If a person other than OSS-ECAL User (individual or corporation or organization) obtains OSS-ECAL by any means, such person shall be deemed to have agreed to the “Terms of Use”(as defined below). If you do not agree to these Terms of Use, please delete the OSS-ECAL without using or referring to it.

1. Definition of Terms

• “We” or “our company” is Rui Long Lab Inc.
• The “site” is the OSS-ECAL site (https://oss-ecal.com/).
• “OSS-ECAL users” are those who have agreed to the “OSS-ECAL Terms of Use”, “Site Terms of Use”, and “Privacy Policy” of this site and have registered as users.
• “OSS-ECAL” stands for Open Source Software for Electronic Components Abstraction Layer. OSS-ECAL is a software layer designed to improve the efficiency of software development for electronic components and the availability of electronic components, and has a software interface tailored to the characteristics of electronic components.
• The “Terms of Use” refers to the OSS-ECAL Terms of Use.

2. Purpose of OSS-ECAL

The purpose of OSS-ECAL is to improve the efficiency of product software development and the availability of electronic components.

3. Permission to use OSS-ECAL

We will permit the use of OSS-ECAL only if all of the conditions in “4. OSS-ECAL Users” are met. The use of OSS-ECAL means to use or modify the OSS-ECAL source code, compile the source code and incorporate it into a computer system as an executable code format. Distribution of the executable code format is permitted only when it is incorporated into a computer system as an executable code format.

4. Terms of Use of OSS-ECAL

• OSS-ECAL users must use electronic components covered by the OSS-ECAL.
• OSS-ECAL users shall comply with the commercial terms and conditions, applicable terms and conditions, and handling precautions for electronic components covered by the OSS-ECAL.
• OSS-ECAL users shall confirm and test the conformity and safety of the electronic components covered by the OSS-ECAL with their intended use and with the regulations corresponding to the region and country in which they are used.
• OSS-ECAL users shall comply with the Foreign Exchange and Foreign Trade Law and other export-related laws and regulations applicable to electronic components covered by the OSS-ECAL.
• OSS-ECAL users must comply with the terms of use of the HAL supported by OSS-ECAL.
• OSS-ECAL users should not allow artificial intelligence (generative AI) to learn OSS-ECAL.
• OSS-ECAL users shall comply with “5. Rights of OSS-ECAL”.
• OSS-ECAL users agree to “6. Exemption from liability for OSS-ECAL”.

5. Rights of OSS-ECAL

Copyrights (including the rights under Articles 27 and 28 of the Copyright Act) and all other intellectual property rights related to the OSS-ECAL belong to our company. The OSS-ECAL is protected by copyright laws, international copyright treaties, and other intellectual property laws and treaties.

6. Exemption from liability for OSS-ECAL

• We provide the OSS-ECAL “as is” and disclaim all liability with respect to this oss-ec, including any implied warranties of merchantability and fitness. In no event shall we be liable for any special, direct, indirect, or consequential damages whatsoever resulting from loss of use, data, or profits, whether in an action of negligence or other tortious action, arising out of or in connection with the use or operation of this OSS-ECAL. We shall not be liable for any special, direct, indirect or consequential damages resulting from loss of use, loss of data or loss of profits caused by use or operation of this OSS-ECAL.
• We are under no obligation to permanently upgrade the OSS-ECAL or to correct any defects in the OSS-ECAL.
• We are under no obligation to provide OSS-ECAL users with technical services related to OSS-ECAL.
• We reserve the right to change the specifications of the OSS-ECAL without notice to OSS-ECAL users. We shall not be liable for any compensation incurred by OSS-ECAL users as a result of such changes.

7. Changes to these Terms of Use

We reserve the right to change these Terms of Use at any time and for any simple reason. Such changes will be posted in these Terms of Use. In the event of material changes, we will notify OSS-ECAL users via e-mail (sent to the e-mail address specified in the OSS-ECAL user’s account) or by means of a notice on the Site before the changes become effective. We strongly recommend that you periodically visit this page for the most up-to-date information regarding these Terms of Use.

8. Applicable law

These Terms of Use shall be governed by and construed in accordance with the laws of Japan. The district court having jurisdiction over the location of our head office shall be the exclusive court of settlement in the first instance for any and all disputes related to these Terms of Use.

9. Other

• If an OSS-ECAL user violates any of these Terms of Use, the permission to use OSS-ECAL will be automatically terminated. In this case, the OSS-ECAL user shall destroy the OSS-ECAL.
• Any matter not stipulated in these Terms of Use or any question arising from the interpretation of these Terms of Use shall be resolved through consultation between OSS-ECAL and the OSS-ECAL user.
